What is an electronic signature?

In compliance with the legislation of the Republic of Azerbaijan, electronic documents signed with electronic signature are equal to documents signed manually and certified with stamp.
E-signature is considered to be an effective solution for those who want to keep pace with the requirements nowadays. Documents signed with electronic signatures can be delivered to necessary places within a few seconds. Despite the fact that all participants of electronic documents circulation are far away from each other, they share the same opportunities. When using the eSignature, documents have the same legal effect as documents created and signed in a paper format.

Where is it possible to obtain electronic signature services?

Electronic signature services can be obtained from Registration centers or online.

Which documents are required to obtain electronic signature card?

When applying to Registration Centers every citizen willing to get an electronic signature card should submit an ID card.  Other documents required from individuals and legal entities as well as civil servants are included in the "Documents" section in the  www.bsxm-ecbar.az.

What is required to use e-signature?

Internet access, the BCSC certificates and  SIM-sized Smartcards are requried to use e-signature. For more information on the use of e-signature please go to  www.bsxm.e-cbar.az, the ‘User rules’ section .

What is a “Time Stamp”?

A “Time stamp” is certified confirmation granted by BCSC that specifies that the document was signed in a particular time. To this end a computer must be connected to the Internet. The Time Stamp is used with the eSignature, as one of the prerequisites for the validity of a particular document.

What is authentication?

Authentication is verification of identification data provided by a user for his/her identification in an electronic environment. Authentication certificates issued by the CBA BCSC.

Can e-signature card be used abroad?

E-signature card can be used abroad as well.

What should I do if the e-signature card is lost, stolen, PIN code is blocked, and the Puk code is forgotten?

In any of the above cases, you need to call or go to the Registration center, the operator will perform necessary operations.

The E-signature certificate has PUK code, but what should be done if the PIN code is forgotten or blocked?

In the pop-up window, enter ACS5-Crypto Mate ACS Certificate Management Utility: - Forgot PIN: In the Change User PIN section, enter Current PIN code, enter the PIN in the New User PIN box - the new pin In Verify New User PIN box, we enter a new PIN again and press the OK button PIN code blocking: In the Unlock User PIN section, enter the PUK code in the SO PIN - In the New User PIN box we add a new PIN, Verify New User In the PIN box,  enter a new PIN again and select the Unlock User PIN key.

Can two different persons sign a prepared document?

Any prepared document can be signed by any number of persons. No limits are set on the number of signatures.

Can one person have two e-signature cards – the first as a legal person, the second as an individual?

Yes. One person can have as many certificates as he/she wishes.

If a document is prepared by different employees or the head of the enterprise, can it be signed on his/her computer (or on some computers)?

Yes, a signature can be put on any computer connected to the Internet with software for e-signature and card reader (for time stamp).

If one side signs a document electronically, while the other one signs it manually, is it considered authentic?

Such a combination is possible. In this case, it is necessary to officially register the electronic document in the listing and to confirm it. Only after that the document can survive in the form of paper.

Why does certificate have a term of activity?

A certificate should have data, the nature and capacity of which is defined by minimum of RFC 2459 (Internet X.509 Public Key Infrastructure Certificate and CRL Profile) document. It may also include other information. For instance, postal address, etc. In a word, the certificate may contain any information which can be operated by AMN SM.
A term of activity is defined for the issued certificate. For instance, it may be considered authentic for 3 years. When the time expires a new certificate is granted to its holder. The term of activity of the certificate depends a lot on information available in it. The more information the document contains, the less useful activity term it gets. It is associated with the fact that information may change, and it will be necessary to grant its holder a new certificate until the term of activity of the old one expires. Besides, any information in the certificate is public. Thus, it becomes clear that it is necessary to include as less information in the certificate as possible. Revocation of certificate is considered as a part of the certification process. Before the expiry of certificate, there are many reasons for its revocation. For example, its holder has changed his/her workplace or lost electronic signature. In such cases the certificate should be revoked immediately. The basic aim is to protect it from random or ill-intentioned use.

Can I give another person the right to use my e-signature card?

As e-signature card belongs to a particular person, so only he/she can use it. Giving the card and the identification code (PIN code) to another person is a serious  violation of security.

How long will it take me to complete the course after registration?

Detailed information per course includes recommended education period. However, as no time limit is set on the course, it can be completed earlier or later.

Should I make payment to pass an exam and get a certificate?

No. The education is free of charge.

Can I pass the exam online?

No. Final examinations per course are conducted in the administrative tower of the Central Bank of the Republic of Azerbaijan.

How is the exam date fixed?

We choose a suitable time after getting in touch with you.

Can I review the course content after getting the certificate?

Yes. You can benefit from course materials any time you want.

STATE REGISTRY FOR ENCUMBRANCE OF MOVABLE PROPERTY

How do I register with the Registry? (How do I get passcode?)

To register, visit www.mpcr.cbar.az, and select the Registration menu in the upper right corner of the web-site, and enter the required details in the fields provided. Individuals and Legal Entities (authorized representatives of legal entities) are eligible for registration. Registration is free.

I registered but can't access my virtual account?

Once you have registered, the information you've entered will be verified, and a login and passcode will be sent to your e-mail. You will be able to access your virtual account when you get these details. It could take up to a few minutes.

Where can I view the Registry’s instruction clips?

At www.mpcr.e-cbar.az, videos are available in the User Guidance sub-menu in the Guidance menu.

What is the priority right referred to in the Law? How do I get a priority right?

Disclosure of encumbrance to third parties under Article 5.3 of the Movable Asset Encumbrances Law affects the priority order of claims in accordance with Chapter 3 of the Law. That is, the person to file the notice of encumbrance first will have a priority right (precedence) over the other claimants (except as otherwise provided in the law).

Can I file a notice for a verbal arrangement?

Yes, you can. However, the parties will need to sign a contract within 30 calendar days. Otherwise the notice of encumbrance will be automatically removed.

Does the Registry accept notices of encumbrance of vehicles?

No. The Law excludes the movable assets registered with the official movable asset registries and securities requiring state registration from the list of eligible objects of encumbrance.

Can I register an item (asset) that is the subject of an encumbrance agreement and does not have several distinguishing features? If yes, how?

Yes, you can. But you have to provide as much detail and distinguishing features as possible in the description part.
